Statement by the Government of the Netherlands

The Secretary-General of the International Maritime Organization has the honour to transmit herewith the statement by the Government of the Netherlands regarding equivalent arrangements accepted under regulation I/5 of the above Convention.

The Secretary-General would be grateful if steps could be taken to bring this information to the attention of the appropriate authorities.

Statement by the Government of The Netherlands

Equivalent arrangement under regulation I/5 of the international Convention for the safety of life at Sea 1974 (SOLAS 74)

The Netherlands being concerned as to the feasibility of safety standards to be applied to passenger vessel of less than 24 metres in length on international voyages feel compelled to make special provisions under the "Equivalent" provisions of the SOLAS Convention for the international certification of those vessels operating in the Caribbean Sea.

Such equivalent arrangements accepted are laid down in the IMO Code of Safety for Small Commercial Vessels Operating in the Caribbean Sea (SCV Code).

Background
It has been recognized that the requirements of the SOLAS Convention 1974 are impractical to apply on passenger vessels of less than 24 metres in length. The Netherlands therefor wishes to exercise the equivalent provisions provided by SOLAS for the application of the IMO Code of Safety for Small Commercial Vessels operating in the Caribbean Seas (SCV Code) and the certification of these vessels under that Code.
In the preamble of the SCV Code allowance is made to apply the Code also to small commercial vessels of 24 metres and over in length engaged on voyages in national waters only; such vessels fall outside the scope the SOLAS Convention, except for the provisions of Chapter V.

Notification
The Government of the Netherlands will apply the IMO Code of Safety for Small Commercial Vessels Operating in the Caribbean Sea (SCV Code) as equivalent provisions for the international certification of passenger vessels of less than 24 metres in length, carrying no more than 150 passengers or provide overnight accommodation for no more than 50 passengers, which are engaged on international voyages within the Caribbean Sea.

Furthermore the Netherlands will apply the provisions of the IMO Code of Safety for Small Commercial Vessels Operating in the Caribbean Sea (SCV Code) as equivalent provisions for the requirements of Chapter V of the SOLAS Convention for small commercial vessels of 24 metres and over in length engaged on voyages in national waters only.
