1          The  Marine  Environment  Protection  Committee,  at  its  fifty-second  session,  and  the MaritimeSafetyCommittee,atitsseventy-ninthsession,approvedtheprocedureagainstwhich thetransferofshipsbetweenflagStatesmightbeconsidered,whichhadbeendevelopedbythe Sub-Committee on Flag State Implementation, as set out at annex.

 

2          TheprocedureaimsatincreasingtransparencyintherelationshipbetweenflagStatesin theinterestofmaritimesafety.  TheissueoftransferofshipsbetweenflagStatesiscoveredina numberofIMOconventionsandinstruments.  Currently,theseplacetheobligationforproviding information  relating  to  ships  on  the  former  flag  State  at  the  voluntaryrequest  of  the  new  flag State.   Therecommendedprocedure,outlinedintheannex,attemptstoencouragethenewflag State to actively seek information.

 

3          MemberGovernmentsareinvitedtobringthiscircularandannextotheattentionofall parties concerned.

Annex

RECOMMENDED PROCEDURE FOR THE TRANSFER OF SHIPS BETWEEN FLAG STATES

 

Forashipengagedoninternationalvoyagestoenjoythebenefitsandprivileges,thatmay be  bestowed  upon  it,  it  must  be  under  the  jurisdiction  of  a  flag  State,  the  flag  of  which  it  is entitledtofly.  TofacilitatetransferofshipsbetweenflagStatesandtoincreasetransparencyin the  relationships  between  former  and  new  flag  States  in  the  interest  of  maritime  safety,  the following procedure is recommended:

 

.1         upontheregistrationofashipnewtotheirregistries,flagStatesshouldendeavour toensurethattheshipinquestioncomplieswiththeapplicableinternationalrules and regulations and, if necessary, liaise with the previous flag State;

 

.2         upontherequestofthenewflagState,theflagofwhichtheshipisentitledtofly, theformerflagStatetheflagofwhichtheshipwasentitledtoflyshouldpromptly providedetailsofdeficiencies,non-conformitieswiththeirapplicabletimescales and any other safety related information.
