1          TheMaritimeSafetyCommittee,atitsseventy-firstsession(19to28May1999)andtheMarine Environment Protection Committee, at its forty-third session (28 June to 2 July 1999), considered the requirementinparagraph13.3oftheISMCodeforacopyofthecompany'sDocumentofCompliance(DOC) tobeplacedonboardinorderthattheMaster,ifsoasked,mayproduceitforverification.

 

2          TheCommitteesagreedthatsuchacopyneednotbeanauthenticatedorcertifiedcopy,assucha requirementmightcauseunnecessaryadministrativeburdensonallpartiesinvolved.TheCommitteesalso agreed that there is nothing in the ISM Code or in SOLAS 1974, as amended, which prevents an Administrationfromrequiringshipsentitledtoflyitsflagtocarryonboardanauthenticatedorcertifiedcopy

oftheDOC.

 

3          Nothing in paragraph 2 above precludes the Administration or port State Authority from taking independentmeasurestoverifytheveracityofthecopyoftheDOConboardwheretherearecleargrounds ofnon-compliancewiththeISMCode.

 

4          MemberGovernmentsareinvitedtobringthisclarificationtothenoticeofallpartiesconcerned.
