Enclosed you may find the information on an exemption granted by the Netherlands under
Regulation 1.11.2 of Chapter 1 of the International Code of Safety for High-Speed craft,
200 for the
m.v. windcat 101, IMO nr. 9574913
The vessel is exempted from the regulation 2.13.1.1 of the International Code of Safety
for High-Speed craft, 2000 stating that the angle of inclination does not normally
exceed 10 degrees in direction.
This exemption is granted bases on the conclusion that a very large extra stability
reserve will be available in a damaged situtation. In some cases even 100 times the
required values.
Furthermore, considering also the temporary angle of heel up to 15 degrees in the
intermediate situations, which is allowed according to the requirements, the Netherlands
Shipping Inspectorate (NSI) accepted the vessel's design as being of equivalent
safety.
A copy of the exemption certificate is attached for circulation to
contracting Governments.

STATEMENT BY THE GOVERNMENT OF THE NETHERLANDS
- Regulation 2.13 of chapter 2 of the International Code of Safety for High-Speed
craft, 2000, concerning buoyancy and stability in the displacement mode following
damage, requires in regulation 2.13.1.1 that the angle of inclination does not
normally exceed 10 degrees in any direction.
- According to Regulation 1.11.2. of Chapter 1 of the International Code of Safety for
High-Speed Craft, 2000, the Administration which allows alternative requirements,
provided that equivalent safety is achieved, shall communicate any such substitutions
to the Organization.

The Netherlands gives notification that the following ship has been granted
permission for a limited deviation of the maximun heeling requirements:

- In some situations the maximum heeling of this ship does not meet regulation
2.13.1.1 as it exceeds the 10 degrees in any direction.
The
Netherlands Shipping Inspectorate (NSI) concluded that a very large extra stability
reserve was available in the damaged situation. In some cases even 100 times the
required values.
Furthermore, considering the fact that the exceeding
angle of inclination is only temporary and reduced within 15 minutes, which is allowed
according to the requirements, NSI accepted the request as of Equivalent safety.
