No 10 - Application of new performance standards for radar equipment.


In accordance with paragraphs 5.3 to 5.6 of the agreement of June 1st 2006 between the Netherlands Shipping Inspectorate and the RO's (as amended), RO's are permitted to issue an exemption in accordance with Solas Chapter V, regulation 3.2.


With regard to the application of the new performance standards for radar equipment, which have entered into force on July 1st 2008 in accordance with IMO resolution MSC.192(79), NSI may consider individual exemptions from full compliance with Solas Chapter V, regulation 18.2.
The exemptions NSI is considering will be granted on the basis of Solas Chapter V, regulation 3.2, especially with reference to the wording "are such as to render the full application of this chapter unreasonable or unnecessary".


When type approved equipment in accordance with IMO resolution MSC.192(79) is not available due to the certification and supply-chain constraints, NSI considers it unreasonable to apply the new performance standards, and deems it appropriate to issue an exemption in such a case.
Certification and supply-chain constraints may be the following:

  • The terms of delivery/specifications for the ship concerned are based on the installation of a radar according to the performance standards in force before July 1st 2008, and;
  • The certification procedure of the radar concerned has not been completed yet due to the late publication of the accompanying testing standard IEC-62388, and;
  • The supply chain requires timely planning.

 

The condition pertaining to such an exemption is that the radar equipment installed is type approved in accordance with the performance standards in force before July 1st 2008, i.e. IMO resolution MSC.64(67) Annex 4.

  1. RO's are permitted to issue exemptions in accordance with this instruction, provided that:
    the RO obtains approval from NSI for the first exemption in accordance with paragraph 5.5 of the agreement, and;
  2. any subsequent exemptions issued are reported without delay to NSI.
