REPORTING PROCEDURE OF OBSERVED DUMPING INCIDENTS-

 

WHICH MAY BE IN VIOLATION OF INTERNATIONAL OCEAN DUMPING TREATIES

(LONDON CONVENTION 1972 AND THE 1996 PROTOCOL THERETO)

 

1          UnderArticleVIIoftheConventiononthePreventionofMarinePollutionbyDumpingof

WastesandOtherMatter(LondonConvention1972),ContractingPartiestothisConvention “agreed

toco-operateindevelopingproceduresfortheeffectiveapplicationofthisConvention,inparticular

on  the  high  seas,  including  also  procedures  for  the  reporting  of  vessels  and  aircraft  observed dumpingincontraventionoftheConvention”.AsimilarprovisioniscontainedinArticle10.3ofthe

1996 Protocol to the London Convention 1972.

 

2          Withincreasedattentionbeinggiventocomplianceissues,andinordertoimplementthis provision,  the  Consultative  Meeting  of  Contracting  Parties  to  the  London  Convention  1972 developed,intheperiod2001-2002,the “ReportingProcedureofobserveddumpingincidents whichmaybeinviolationofinternationaloceandumpingtreaties(LondonConvention1972andthe1996  Protocol  thereto)”, as  set  out  in  the  attachment  hereto.      The IMO  Marine  Environment ProtectionCommittee(MEPC),atits49th  sessionheldinJuly2003,reviewedthisprocedurebut offered no comments.

 

3          ItwasagreedthattheSecretariatshouldfilethe “IncidentInformationForms”itreceivedand presentacompilationofthemtoeachConsultativeMeetingforappropriateconsideration;andthat this process would be for a trial period of no more than three years.

 

4          MEPCNationalfocalpointsarekindlyinvitedtobringthisReportingProceduretothe attention  of  relevant  administrations,  institutions,  enforcement  agencies,  networks  of  mariners, associationsofpilotsandairlinepilots,etc.  ThisReportingProcedureisalsodistributedtoLondon Convention National focal points under LC.2/Circ.430.

REPORTING PROCEDURE OF OBSERVED DUMPING INCIDENTS WHICH MAY BE IN VIOLATION OF INTERNATIONAL OCEAN DUMPING TREATIES

(LONDON CONVENTION 1972 AND THE 1996 PROTOCOL THERETO)

 

 

 

I          GENERAL GUIDANCE

 

A.        ThecountriesthatsignedtheLondonConvention1972andthe1996Protocoltheretoare interestedinensuringcompliancewiththeseinternationalenvironmentalagreementsthatcontrolthe dumpingofwastesintothesea.  Marinersoperatinginacountry'sterritorialwatersoronthehigh seas,orotherpersonsmayobserveincidentsthatcouldbeviolationsoftheLondonConventionor

the 1996 Protocol.

 

B.         Ifamarinerorotherobserver(“IncidentObserver”)witnessesadumpingincidentinany ocean waters that appears to be in violation of the London Convention 1972orthe1996Protocol, please do the following:

 

.1         Immediately  notify,  if  possible,  the  relevant  coastal  contact  point  so  the  proper authorities can determine an appropriate action.  A list of contacts can be found in: List   of   National   Operational   Contact   Points   Responsible   for   the   Receipt, TransmissionandProcessingofUrgentReportsonIncidentsInvolvingHarmful Substances,  Including  Oil  from  Ships  to  Coastal  States  (MEPC.6/Circ.7).   This documentisavailableon-line,viatheInternet,at:http://www.imo.org(pleaseselect “Circulars” then select “ContactPoints”); and

 

.2         CompletetheattachedDumpingIncidentInformationFormandSupplementary InformationFormascompletelyaspossible.  Theseformsareavailableon-lineat: http://www.londonconvention.org.

 

C.        AnIncidentObserverwitnessinganincidentshouldkeepinmindthefollowinginformation

in relation to ocean dumping:

 

.1         Dumping  activities  that  may  be  in  violation  of  the  London  Convention  or  the Protocolincludeanydeliberatedisposalintotheseaofwastesorother matterfrom vessels, aircraft, platforms or other man-made structures at sea.

 

.2         Certainwastesareacceptablefordumpingintothesea,providedapermithasbeen issuedforthedumpingoperation.   Afulldescriptionofwhatisandwhatisnot prohibitedforoceandumpingmaybefoundinArticlesIIIandIVandAnnexesIand

IIoftheConventionandinArticle1andAnnex1oftheProtocol.  Thefulltextof the  Convention       and           the                     Protocol          are               available                   on-line       at: http://www.londonconvention.org/London_Convention.htm.
