INTERIM GUIDELINES FOR THE APPLICATION OF THE NOx TECHNICAL CODE

1 The Conference of Parties to the International Convention for the Prevention of Pollution from Ships,1973, as modified by the Protocol of 1978 relating thereto, held from 15 to 26 September 1997 in conjunctionwiththeMarineEnvironmentProtectionCommittee'sfortiethsession,adopted,inConference Resolution2,theTechnicalCodeonControlofEmissionofNitrogenOxidesfromMarineDieselEngines
(TheNOxTechnicalCode).
2ThepurposeoftheNOxTechnicalCodeistoestablishmandatoryproceduresforthetesting,surveyand certification of marine diesel engines which will enable engine manufacturers, shipowners and Administrations to ensure that all applicable marine diesel engines comply with the relevant limits far emissionvaluesofNOxasspecifiedinregulation13ofAnnexVItoMARPOL73/78.
3itisnotedthatregulation13ofMARPOLAnnexVIisintendedtobeappliedtodieselenginesinstalled
on ships constructed on or after 1 January 2000. While the requirements of the regulation could not be enforced beforethe entry into forceof the Protocol of 1997, it should be clearly understood that engines installedonshipsconstructedonorafter1January2000orengineswhichundergoamajorconversiononor after1January2000willhavetomeettheserequirementsoncetheProtocolentersintoforce.
4 To allow uniform application of the Code, and to assist Administrations in certifying engines in accordancewithit,priortothedateofentryintoforceofAnnexVI,theguidelinesattachedatannextothis Circulararerecommendedtobeused.
ANNEX
1Eachenginewhichwillbecome,retrospectively,subjecttotheprovisionsofregulation13ofAnnexVIof MARPOL 73/78 upon its entry into force, should be certified in accordancewith the requirements of the NOxTechnicalCode.
2 Pending entry into farce of Annex VI and upon satisfactory compliance with the Code requirements, a
"Statementofcompliance"withtheNOxTechnicalCodeshouldbeissuedbytheflagStateAdministration,
oranorganizationactingonbehalfofthatAdministration.SuchaStatementofComplianceshouldcontain
asaminimumtheinformationasrequiredbyappendix1oftheNOxTechnicalCode.
3 The Statement of compliance is intended as an interim measure pending issuance of the Engine International Air Pollution Prevention (EIAPP) and/or International Air Pollution Prevention (IAPP) CertificateuponentryintofarceofAnnexVI.
4 Administrations are urged to take into consideration the Statement of Compliance when issuing certificatesinaccordancewithAnnexVI,whetherornottheStatementofcompliancewasissuedbytheir Administration,ororganizationsactingontheirbehalforbyotherGovernments.
