De Nederlandse Zorgautoriteit (NZa) heeft met inachtneming van Hoofdstuk 4, paragrafen 4.2 en 4.4, van de Wet marktordening gezondheidszorg (Wmg),

alsmede de beleidsregel:

• Beleidsregel prestaties en tarieven medisch-specialistische zorg, kenmerk BR/REG - 22114a;

 

de nadere regel:

• Regeling medisch-specialistische zorg, kenmerk NR/REG-2207a;

 

en de tariefbeschikking:

• Prestatie- en tariefbeschikking medisch-specialistische zorg, kenmerk TB/REG-22613-02;

door zorgaanbieders van:

1. medisch-specialistische zorg;
2. audiologische zorg;
3. trombosezorg;
4. zorg in het kader van erfelijkheidsadvisering;
5. geriatrische revalidatiezorg;

De hierboven genoemde prestaties en bijbehoreden tarieven zijn opgenomen in de G-Standaard van Z-Index. Uit de G-Standaard blijkt ook vanaf welke datum deze prestatie en het bijbehorende tarief in rekening kan worden gebracht als add-ongeneesmiddel.

 

 

Voorwaarden, voorschriften en beperkingen

Ten aanzien van het hierboven gestelde gelden de navolgende voorwaarden, voorschriften en/of beperkingen:

 

1. Add-ongeneesmiddelen vallen onder de categorie ‘overige zorgproducten’ als bedoeld in artikel 1, onderdeel ee, van de Beleidsregel prestaties en tarieven medisch-specialistische zorg.
2. Voor overige zorgproducten, waaronder add-ongeneesmiddelen, gelden maximumtarieven als bedoeld in artikel 50, eerste lid, onder c, Wmg.
3. De tarieven die op grond van deze beschikking voor add-ongeneesmiddelen in rekening kunnen worden gebracht, zijn integrale tarieven als bedoeld in artikel 1, onderdeel w, van de Beleidsregel prestaties en tarieven medisch-specialistische zorg en artikel 1, onderdeel u, van de Regeling medisch-specialistische zorg.
4. Indien het door de NZa vastgestelde tarief voor een add-ongeneesmiddel hoger is dan de maximumprijs die in het kader van de Wet geneesmiddelenprijzen (WGP) is vastgesteld, dan geldt de WGP maximumprijs als maximumtarief voor dat add-ongeneesmiddel.
5. De zorgaanbieders, hierboven genoemd onder de nummers 1 tot en met 5, mogen de in deze beschikking genoemde (integrale) tarieven slechts in rekening brengen, indien en voor zover zij voldoen aan de definitie van ‘zorgverlener’3 als bedoeld in de Beleidsregel prestaties en tarieven medisch-specialistische zorg en de Regeling medisch specialistische zorg.
6. Indien een zorgverlener, als bedoeld in voorschrift 4, een instelling4 is, dan mag die instelling de in deze beschikking genoemde (integrale) tarieven slechts in rekening brengen, indien en voor zover hij over een toelating als bedoeld in artikel 5, eerste lid, van de Wet toelating zorginstellingen (WTZi) beschikt.
7. Indien een zorgverlener, als bedoeld in voorschrift 4, een solist5 is, dan mag die solist de in deze beschikking genoemde (integrale) tarieven slechts in rekening brengen, indien en voor zover hij in het bezit is van een door de NZa afgegeven individuele beschikking als bedoeld in artikel 16, tweede lid, van de Beleidsregel prestaties en tarieven medisch-specialistische zorg, respectievelijk artikel 31, derde lid, van de Regeling medisch-specialistische zorg.  
8. In aanvulling op de voorschriften 4, 5 en 6 geldt dat de in die voorschriften bedoelde zorgverleners tevens ‘eigen zorgverleners’ als bedoeld in artikel 1, onderdeel o, van de Beleidsregel prestaties en tarieven medisch-specialistische zorg en artikel 1, onderdeel m, van de Regeling medisch-specialistische zorg, dienen te zijn om de in deze beschikking genoemde (integrale) tarieven rechtsgeldig in rekening te kunnen brengen. 
9. Deze tariefbeschikking is niet van toepassing op zorgprestaties die in het kader van onderlinge dienstverlening als bedoeld in artikel 1, onderdeel bb, van de Beleidsregel prestaties en tarieven medisch-specialistische zorg en artikel 1, onderdeel z, van de Regeling medisch-specialistische zorg, door de ene zorgaanbieder aan de andere in rekening worden gebracht.
10. De declaratiebepalingen (voorschriften, voorwaarden of beperkingen) opgenomen in de Beleidsregel prestaties en tarieven medisch-specialistische zorg, respectievelijk de Regeling medisch-specialistische zorg, met betrekking tot add-ongeneesmiddelen zijn, tenzij hiervan in deze beschikking wordt afgeweken, van overeenkomstige toepassing.

 

 

Inwerkingtreding

 

Deze beschikking treedt in werking met ingang van 1 januari 2022.

Indien de Staatscourant waarin de mededeling als bedoeld in artikel 20, tweede lid, onderdeel d, van de Wet marktordening gezondheidszorg (Wmg) wordt geplaatst, wordt uitgegeven na 1 januari 2022, treedt de beschikking in werking met ingang van de dag na de datum van uitgifte van de Staatscourant waarin de mededeling wordt geplaatst en werkt zij terug tot en met 31 december 2021. 

 

In afwijking van het bovenstaande treedt deze beschikking niet eerder in werking dan de datum waarop Z-Index het betreffende geneesmiddel, voorzien van een tarief heeft opgenomen in de G-Standaard en deze gewijzigde versie van de G-Standaard heeft gepubliceerd.

 

 

Bezwaarclausule

 

Indien u het niet eens bent met dit besluit dan kunt u binnen zes weken na bekendmaking van dit besluit een bezwaarschrift indienen bij de Nederlandse Zorgautoriteit. U kunt uw bezwaar indienen: via de website (www.nza.nl/bezwaar), per post of per fax. Het is niet mogelijk uw bezwaar via de e-mail in te dienen.

Het bezwaar dient volgens artikel 6:5, eerste lid, van de Algemene wet bestuursrecht schriftelijk en ondertekend te worden ingediend en dient ten minste de volgende gegevens bevatten:

• naam en adres van de indiener;
• de dagtekening;
• een omschrijving van het besluit waartegen het bezwaar zich richt;

Toelichting

In de onderhavige beschikking stelt de NZa een add-on prestatie met bijbehorend tarief vast en informeert over de datum van inwerkingtreding van het besluit.

Op verzoek van het ministerie van VWS stelt de NZa per 1 Jan 2022 ambtshalve add-on prestaties vast voor epoëtines en G-CSF middelen.

De vastgestelde prestaties en tarieven van add-ongeneesmiddelen komen tot uiting in de G-Standaard van Z-Index, welke maandelijks wordt gepubliceerd. De in de G-Standaard opgenomen geneesmiddelen zijn voorzien van ZI-nummers. Registratie en declaratie van add-on geneesmiddelen gebeurt op basis van deze ZI-nummers. 

Wanneer de NZa besluit tot vaststelling, wijziging of intrekking van één of meerdere add-ongeneesmiddelen, stelt zij een prestatie- en tariefbeschikking vast. De NZa publiceert de prestatie- en tariefbeschikkingen op de website en doet hiervan mededeling in de Staatscourant. Prestatie- en tariefbeschikkingen voor add-ongeneesmiddelen treden niet eerder in werking dan de datum waarop Z-Index het betreffende add-ongeneesmiddel, voorzien van een tarief, heeft opgenomen in de G-Standaard en deze gewijzigde versie van de G-Standaard heeft gepubliceerd.

Tot zes weken na de datum van bekendmaking van deze beschikking staat bezwaar open tegen de in deze beschikking genoemde add-onprestatie(s). De datum van bekendmaking is de dag na de datum waarop van de vaststelling van dit besluit mededeling wordt gedaan in de Staatscourant.

Tarief

De NZa stelt één keer per jaar de tarieven voor add-ongeneesmiddelen vast zoals deze met ingang van 1 januari van jaar t+1 zullen gelden. Meer informatie over de tarieven is te vinden in de Beleidsregel prestaties en tarieven medisch-specialistische zorg.
