237 Interim measures in the case of defective oil discharge monitoring and control systems for oil tankers

Interim measures in the case of defective oil discharge monitoring and control systems for oil tankers (MARPOL reg I/15(3)

  1. Regulation 15 (3)(a) of Annex I of MARPOL 73/78 requires an oil tanker to rectify defective oi1 discharge monitoring and control systems before its next ballast voyage unless it is proceeding to a repair port.

  2. By adoption of resolution MEPC.10(18) on 2.5 March 1983 the Marine Environment Protection Committee (MEPC) resolved, inter alia, to develop, as soon as possible, interim measures which should be applied in case of an equipment deficiency .

  3. In accordance with the above, the MEPC at its thirtieth session in November 1990, agreed with the interim measures as annexed to this circular.

  4. Parties to MARPOL 73/78 may wish to apply these measures pending eventual entry into force of an amendment to regulation 15(3) (a) which the MEPC is scheduled to consider with a view to adoption at its thirty-first session in July 1991.

 

 

Annex Interim measures in the case of defective oil discharge monitoring and control systems for oil tankers


1 Pending the entry into force of the envisaged amendment to Regulation 15(3) (a) of Annex I of MARPOL 73/78, an oil tanker that is required to be equipped with an ODMC system, if arriving in a Port State with a defective system, should be allowed to commence only one ballast voyage before proceeding to a repair port. The tanker should either:
    .1 if the tanker operates outside a special area, use the ODMC system manualalternative referred to in regulation 15(3) and discharge accordance with regulation 9(1) (a). These procedures are subject the State authority being satisfied that the master has documentary evidence such as service records, equipment maintenance log, etc. to verify:

      .1.1 that the system has barn maintained in accordance with the manufacturer's recommendations;

      .1.2 that any functional defects in the system since the last inspection by a recognized authority have been recorded in the Oil Record Book: and

      .1.3 that the master, in good faith, had made every reasonable effort to rectify the defective equipment. or
      .2 if the tanker operates in a special area, retain all dirty ballast and oil contaminated water from the cargo tank areas on board for subsequent discharge to shore reception facilities. The ship's master should confirm that adequate facilities will be available at the port or terminal.
