GUIDELINES FOR APPLICATION OF MARPOL ANNEX I REQUIREMENTS TO FPSOs AND FSUs

 

 

 

1          TheMarineEnvironmentProtectionCommittee,atitsforty-ninthsession(14to18July

2003),recognizingthenecessitytoprovideappropriate guidance for the application of MARPOL AnnexIrequirementstofloatingproduction,storageandoffloadingfacilities(FPSOs)usedforthe offshoreproductionandstorageofoil,andfloatingstorageunits(FSUs)usedfortheoffshore storageofproducedoil,approvedtheGuidelinesforapplicationofMARPOLAnnexIrequirements

to FPSOs and FSUs, set out in the annex.

 

2          MemberGovernmentsareinvitedtousetheannexedGuidelineswhenapplyingrelevant provisionsofMARPOLAnnexItoFPSOsandFSUsandtobringthemtotheattentionofallparties concerned.

ANNEX

 

GUIDELINES FOR APPLICATION OF MARPOL ANNEX I REQUIREMENTS TO FPSOS AND FSUS

 

1          ThepurposeoftheseGuidelinesistoprovideforuniformapplicationofMARPOLAnnexI

toFloatingProduction,StorageandOffloadingfacilities(FPSOs)andFloatingStorageUnits(FSUs)

that are used for the offshore production and storage or for offshore storage of produced oil.

 

2          TheMarineEnvironmentProtectionCommittee,atitsforty-ninthsession(14to18July

2003),notedthecomplexissuesinvolvedinapplyingtherequirementsofMARPOLAnnexIto FPSOsandFSUs,whosearrangements,functionsandoperationsfallundertheover-ridingcontrolof coastal States.

 

3          Inaddition,theCommitteefoundthattheroleofFPSOsandFSUsinoperationdoesnot includetransportofoil.Accordingly,FPSOsandFSUsareaformoffloatingplatformanddonotlie withinthedefinitionofoiltanker inMARPOLregulationI/1(4).  Theyarethereforesubjecttothe provisions of Annex I that relate to fixedand floating platforms, including regulation 21.

 

4          The  Committee  noted  that  the  environmental  hazards  associated  with  the  quantities  of producedoilstoredonboardoperationalFPSOsandFSUsaresimilartosomeofthehazardsrelated

tooiltankersandthatrelevantrequirementsofMARPOLAnnexIinrelationtooiltankers couldbe adaptedtoaddressthosehazardsinanappropriatemanner.Basedontheaboveandrecognizingthat thesefloatingplatformsarestationarywhenoperating,theCommitteerecommendsthatcoastal States,flagStatesandothersassociatedwiththedesign,constructionandoperationofFPSOsand FSUsapplytherelevantMARPOLAnnexIregulationsreferredtoinannex1totheGuidelines. Referencescontainedinannex1relatetoMARPOLAnnexIuptoandincludingtheamendments contained in resolution MEPC.95(46).

 

5          This  circular  has  been  prepared  with  a  view  to  providing  the  necessary  guidance  and interpretationinformationwhichmaybespecificallyapplicabletoFPSOsandFSUs,andaccordingly representsasingledocumentdescribingtheapplicationofMARPOLAnnexItothesefloating platforms.

 

6          TheprovisionsofthiscircularareforapplicationtoFPSOsandFSUswhenlocatedattheir operating station.  However they also take into account the abnormal and rare circumstances of:

 

.1         voyages for drydocking, repair or maintenance work; or

 

.2         disconnection of the platformin extreme environmental or emergency conditions.

 

Ineithercase,theFPSO/FSUshouldnottransportoiltoaportorterminalexceptwiththespecific agreementoftheflagandrelevantcoastalStates,obtainedonavoyagebasis.Whenundertakingany voyageawayfromtheoperatingstation,forwhateverpurpose,FPSOsandFSUswillberequiredto comply with the discharge provisions of MARPOL Annex I foroil tanker s.

 

 

 

 

 

7          InordertoavoiddevelopmentofanentirenewtextfromMARPOLAnnexIattendingto

suchterminologymattersandnotwithstandingthebasisfortheseGuidelinesoutlinedabove,inany regulation  indicated  to  apply  to  FPSOs  and  FSUs  by  the  Guidelines  at  annex,  the  following interpretation of terminology should be used:

 

.1         “oiltanker” should be read as “FPSO or FSU”;

 

.2         “carry” should be read as “hold”;

 

.3         “cargo” should be read as “produced oil and oily mixtures”; and

 

.4         “voyage” should be read to include “operations”.

 

8          OiltankerrequirementsthatareextendedbytheGuidelinestoapplytoFPSOs/FSUsare identified  through  the  phrase  “recommend  application” or  similar,  while  “applies” is  used  for requirements to be implemented irrespective of the contents of this circular.

 

9          The   requirement   for   oil   tankers   to   undergo   the   enhanced   survey   programme

(resolution A.744(18))wasdeletedfromregulationI/13GofMARPOLbyresolutionMEPC.95(46) anditsprovisionshavesubsequentlybeensolelygiveneffectthroughChapterXI-IofSOLAS. SinceSOLASdoesnotapplytothevastmajorityofFPSOsandFSUs,whicharepermanently mooredattheiroperatingstations,therelevantoiltankerrequirementsofresolutionA.744(18)have beenincludedasoneoftheprovisionsoftheGuidelinesinordertoensureasatisfactorystandardof structuralintegrityforFPSOsandFSUs.  ReflectingtheoperationalcharacteristicsofFPSOsand FSUs,  the  Guidelines  also  make  provision  for  limited  departure  from  A.744(18)  in  respect  of acceptanceofin-watersurveysunderconditionswhichdonotcompromisesafetyandpollution prevention.

 

10        ItisrecommendedthatcontractingGovernmentsgiveeffecttotheprovisionsofthisCircular

toFPSOsandFSUsassoonaspracticable,butnotlaterthantwoyearsafterdateofapprovalofthis circularforconstructionorconversioncontractsplacedonorafterthatdate.  Intheabsenceofa buildingorconversioncontract,thekeellayingdateforpurpose-builtnew-constructionFPSOsand FSUs  or  the  commencement  date  of  a  ship's conversion  should  be  used.                                                                   FPSOs  and  FSUs contracted,  built  or  converted  prior  to  that  date  need  not  be  upgraded  in  accordance  with  the provisions of the circular.

 

11        Inimplementingtheprovisionsofthiscircular,MemberGovernmentsareinvitedtouseand recognizetheRecordofConstructionandEquipmentforFPSOsandFSUsatannex2inplaceof Forms A and B appended to Annex I of the Convention.

 

12        TheCommitteenotedthatmostoperationsofFPSOsandFSUsaredifferentfromotherships covered by Annex Iand,recognizingthat the coastalStatehasjurisdictionoverfixedandfloating platformsoperatinginwatersunderitsjurisdiction,MemberGovernmentsmayfinditnecessaryto depart  from  the  provisions  of  this  Circular.                                                                  Accordingly,  the  Committee  invites  Member GovernmentstoadvisetheOrganizationoftheirexperienceinapplyingthisCircularsothatitcanbe taken into account if future amendments to this Circular are deemed necessary.
